The following Terms and Conditions are agreed upon:

PREAMBLE

The Seller sells self-published musical scores through their website (www.earlyharpmusic.net). The list and description of the goods offered can be consulted on the above-mentioned site.

Article 1: Purpose
The present General Terms and Conditions of Sale determine the rights and obligations of the parties within the framework of the online sale of Products offered by the Seller.

Article 2: General provisions
These General Terms and Conditions of Sale (GTS) apply to all sales of products made through the www.earlyharpmusic.net website, which are an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these Terms and Conditions at any time by publishing a new version on its website. The applicable GCS then are those existing on the date of payment of the order. These GTC can be consulted on the Company's website at the following address: www.www.earlyharpmusic.net/resources/GTC.pdf .
The Buyer declares that they have read all of these General Terms and Conditions of Sale and accept them without restriction or reservation. The Buyer acknowledges that they have benefited from the advice and information necessary to ensure that the offer meets their needs. The Buyer declares that they are in a position to contract legally under French law or validly represent the natural person or legal entity for which they are committing themselves. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

Article 3: Price
The prices of the products sold through the www.earlyharpmusic.net website are indicated in Euros excluding taxes and precisely determined on the Product description pages, including shipping costs.

For products shipped outside Switzerland, the European Union and/or French Overseas Departments and Territories, customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Vendor. They shall be borne by the Buyer and are his responsibility (declarations, payment to the competent authorities, etc.). The Seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities.

The Seller reserves the right to modify their prices at any time in the future. The telecommunication costs necessary to access the Vendor's website are to be borne by the Buyer.

Article 4 : Shipping costs
Shipping costs include a contribution to the costs of preparation, packaging and postage.
They are fixed and determined according to the amount of the order, the shipping method and the country of destination.

Article 5: Conclusion of the online contract
The Buyer will have to follow the following steps to be able to carry out his order:
Information on the essential characteristics of the Product;
Choice of the Product, its options if any and indication of the essential data of the Buyer (identification, address...) by means of a form to be filled in;
Acceptance of these General Terms and Conditions of Sale.
Verification of the elements of the order and, if necessary, correction of errors.
Follow-up of payment instructions, and payment of the products.
Delivery of the products.
The Buyer will then receive confirmation by e-mail of the payment of the order, as well as an acknowledgement of receipt of the order confirming it. He will receive a .pdf copy of these general terms and conditions of sale. For the products delivered, this delivery will be made to the address indicated by the Buyer. For the purposes of proper execution of the order, the Buyer undertakes to provide true identification details. The Vendor reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.

Article 6: Products and services
The essential characteristics of the goods and their respective prices are made available to the buyer on the website www.earlyharpmusic.net. The buyer certifies that he has received a detail of the delivery costs as well as the terms of payment, delivery and execution of the contract. The Vendor undertakes to honour the Buyer's order within the limits of available Product stocks only. Failing this, the Seller shall inform the Buyer. This contractual information is presented in detail. In accordance with French law, they are the subject of a summary and a confirmation when the order is validated. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The period of validity of the offer of the Products as well as their prices is specified on the website www.earlyharpmusic.net. Except in the case of special conditions, the rights granted hereunder are granted solely to the person signing the order (or the person holding the email address communicated).

Article 7: Ownership reserve clause
The products remain the property of the Seller until full payment of the price.

Article 8 : Delivery terms
The products are delivered to the delivery address that was indicated at the time of the order and within the period indicated.
The transit times are those indicated by the Post Office and correspond to the delivery method you have chosen.
In the event of late delivery (more than three weeks after ordering for Europe, more than 6 weeks after ordering for Worldwide shipping), the Buyer has the possibility to cancel the contract. The Vendor will then proceed to reimburse the product and the outward shipping costs.
The Vendor provides a telephone contact point (cost of a local call from a landline) indicated in the order confirmation email in order to follow up on the order.
The Vendor reminds the Buyer that at the moment when the Buyer takes physical possession of the products, the risks of loss or damage to the products are transferred to them. It is the Buyer's responsibility to notify the carrier of any reservations about the delivered product.

Article 9: Availability and presentation
Orders will be processed while stocks last. In case of unavailability of an article for a period longer than 12 working days, you will be immediately informed of the foreseeable delivery times and the order of this article may be cancelled on request. The Buyer may then request a refund of his order.

Article 10 : Payment
Payment is due immediately upon ordering.
It will be made either
- by credit card through the secure Paypal system, which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted in the best possible way and cannot be read during transport on the network.
The Buyer will receive by e-mail an invoice containing a link for payment.
Once the payment has been initiated by the Buyer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the French Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his banking information at the time of the sale, the Buyer authorises the Vendor to debit his card for the amount relating to the price indicated. The Buyer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the Sale is immediately cancelled by operation of law and the order is cancelled.

Article 11: Withdrawal period

11.1 Exception to the withdrawal period for digital products
By ticking the box "In regard to digital products: I explicitly agree that the execution of the contract is started before the end of the cancellation period. I am aware that my right of cancellation ends with the beginning of the execution", the Buyer waives the right of withdrawal for the downloading of their pdf. Once the Buyer has received the links to download or read online the digital files ordered, the Buyer is no longer able to cancel the order and the purchase price will be automatically debited, even if the Buyer subsequently decides not to download the files.

11.2 Withdrawal period for physical products
The consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of the cost of return. The time limit mentioned in the previous paragraph shall run from receipt in the case of goods or acceptance of the offer in the case of services.
The right of withdrawal may be exercised by contacting the Company by e-mail at contact@earlyharpmusic.net or via the contact form on the website.

If the right of withdrawal is exercised within the above-mentioned period, only the price of the product(s) purchased and the shipping costs will be refunded, the return costs remain the responsibility of the Buyer. Returns of products must be made in their original condition and complete so that they can be remarketed as new; they must be accompanied if possible by a copy of the proof of purchase.
Refunds will be made by Paypal transfer within 10 days after receipt of the products.

Article 12: Guarantees
In accordance with the law, the Seller assumes two guarantees: of conformity and relating to hidden defects of the products. The Vendor will reimburse the buyer or exchange products that are apparently defective or do not correspond to the order placed.
The request for reimbursement must be made by e-mail to contact@earlyharpmusic.net or via the contact form on the site.

In case of exchange, the return postage costs will be refunded to the Buyer within 10 days after good receipt of the products, on the flat rate of 6 euros for France (price of an envelope + letter rate) or upon receipts.
In the event of reimbursement, the price of the products and the outward shipping costs will be reimbursed within 10 days after receipt of the products, as well as the return shipping costs on a flat-rate basis of 6 euros for France (price of an envelope + letter rate) or based on receipts.

Article 13: Intellectual property rights
All information subject to intellectual property rights is and remains the exclusive property of the seller. No transfer of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

Article 14: Force majeure
The performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure that would prevent performance. The seller will notify the buyer of the occurrence of such an event as soon as possible.

Article 15: Nullity and modification of the contract
If one of the stipulations of this contract were to be cancelled, this cancellation would not entail the cancellation of the other stipulations which will remain in force between the parties. Any contractual modification is valid only after a written and signed agreement of the parties.

Article 16: Protection of personal data
You have the right to question, access, modify, oppose and rectify any personal data concerning you. By adhering to these terms and conditions of sale, you consent to the collection and use of this data by us for the purposes of this contract.

Article 17: Applicable law
All the clauses in these general terms and conditions of sale, as well as all the purchase and sale operations referred to therein, shall be subject to Swiss law.
